The Resource Education Licence Agreement

We have tried to make our Licence as straightforward as possible. Briefly:

You may install an unlicensed copy of the software from the CD as many times as you wish: this is an Evaluation Licence. These copies will be limited in some way, but we hope will will get some idea of how the program works and how it may be of use to you.
Other clauses on the misuse of our software still apply.

When you buy a licence, Resource Education will send you a serial number which will give you access to the entire program. You may only use the number of installations that you have purchased with the licence. For Home Use, this is a single-user licence only.

In addition, staff may legally use complete installations on their privately-owned machines, provided this is for use at home to learn how to use the software or to develop curriculum materials. This does not apply to Home Use Licences.

The Full Licence

The Licensee is responsible for ensuring that all personnel who have access to the software are made aware of, and are bound by, the conditions of this Licence.

In consideration of payment of the licence fee (which is part of the price paid for a product) Resource Education, as copyright holder and/or Licensor, grants to you, the Licensee, a right to use the software only within the terms of this licence.

You may install fully-operational copies of the software (software for which you have a licensed serial number) on as many machines for which the licence was purchased.

Home user licences may only be used in a domestic environment.

On stand-alone computers, you may only install fully-operational copies of the software on the number of client machines owned by the Licensee for which a licence has been purchased.

On networks, a single installation may be made on a server for use on the number of client machines owned by the Licensee for which a licence has been purchased. This does not apply to Home Use Licences.

You may also split the number installations between stand-alone and networked machines provided the number of stand-alone installations plus the number of permitted clients on the network does not exceed the licensed number of users. This does not apply to Home Use Licences.

Fully-operational copies may also be freely installed on the privately-owned computers of members of staff of the Licensee, provided that these installations are used solely for the the training of the member of staff or for the development curriculum materials. Such an installation does not count against the licensed number of users. This does not apply to Home Use Licences.

As Licensee, you are not permitted to modify the software code in any way except where specific instructions are given in the documentation. You are not permitted to incorporate any part of the code in any other software, without the written permission of Resource Education.

The licence and serial number are not transferable. Use on any other site other than a site controlled by the Licensee is not permitted unless an extension to use has been granted by Resource Education.

Ownership of software: As the Licensee, you own the physical media on which the software is originally or subsequently recorded or fixed, but Resource Education retains title and ownership of the software recorded on the original disk copy and all subsequent copies of the software regardless of the form or media in or on which the original and other copies may exist. This software is not a sale of the original software or any copy.

Termination: This Licence is effective until terminated by Resource Education. It will terminate automatically without notice from Resource Education if you fail to comply with any provision of this Licence. Upon termination you shall destroy the written materials and all copies of the software, including modified copies, if any.

Governing law: This Licence Agreement is to be governed by, and interpreted in accordance with the law of England and Wales and the parties agree to submit to the jurisdiction of the High Court of England and Wales.
