Wife can request generic details of her husband’s net taxable income and gross income under RTI: CIC

Feeling aggrieved and dissatisfied, the appellant filed a second appeal.

The Commission ordered the respondent to inform the applicant of the generic details of the net taxable income/gross income of her husband held and available from the public authority for the period 2017-2018, within 15 working days from from the date of receipt of the order.

Recently, the Central Information Commission said that the wife can request generic details of her husband’s net taxable income and gross income under the ITR.

The Information Commissioner Saroj Punhani was dealing with the application where the wife requested the Commissioner to disclose the gross income as well as the net taxable income after claiming deductions under Chapter VI-A of the Income Tax Act 1961 on the returns of income produced by her husband for the valuation year 2013-14 to the valuation year 2020-21.

The appellant filed an online RTI request requesting information relating to her husband Sanket Thapar for the valuation years ranging from valuation year 2013-14 to valuation year 2020-21 to defend her matrimonial matter pending in court and to claim the just amount of child support for herself and her minor daughter under the Domestic Violence Act 2005 and Hindu Marriage Act 1954 etc.

The CPIO rejected the request filed by the applicant.

Dissatisfied, the appellant filed a first appeal. The FAA order of 23.12.2020 confirmed the CPIO’s response.
